ZippSlip Terms and Conditions

ZippSlip.com is a voluntary, secure web service offered by your school herein referred to as the “school” which provides a communications framework wherein

1) Parents and students (you) provide information requested by your school about you by receiving, completing, and returning electronic forms, sometimes with an associated agreement of consent or authorization which you give by either signing in via username and password, or optionally with an additionally required personal I.D. number (PIN).

2) When requested, and entirely optionally, users authorized in ZippSlip as parents (never student users) may elect to also make a payment associated with school form which may be for a required fee, payment for expenses associated with school activities, or donations.

3) Similar to your school’s use of its various existing websites which are public, still images, videos, or audio recordings of you may be shared electronically over the internet with other users who have been authenticated and authorized as users of the ZippSlip system, entirely within the ZippSlip system.

This User Agreement constitutes a legal agreement between you and ZippSlip. You must accept without modification all of the terms, conditions, and notices contained in this User Agreement in order to access and use ZippSlip. If you do not accept these Terms of Use in their entirety, you may not access or use ZippSlip. Using your ZippSlip account indicates your acceptance of this User Agreement.

PRIVACY POLICY

User information entered into electronic forms in ZippSlip are shared with designated personnel at your school.We will never sell, trade, or rent Users personal identification information to others, and we do not maintain, analyze, or store credit card information after the completion of any specific transaction.ZippSlip is committed to maintaining your privacy by adopting and deploying the highest industry standard practices for data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored as a result of use of ZippSlip.

Throughout this policy, we use the term “personal information” to describe information that can be associated with a specific person and can be used to identify that person. We do not consider personal information to include information that has been anonymized so that it does not identify a specific user.

We may request and collect personal identification information from Users through a variety of ways. Users may be asked for, as appropriate, name, email address, mailing address, phone number, or credit card information. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, although that may prevent them from using certain ZippSlip related activities.

Sensitive and private data exchange between ZippSlip and its Users happens over a SSL secured communication channel and is encrypted and is always protected with digital signatures.

Our Site may use “cookies” to enhance User experience. User’s web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. User may choose to set their web browser to refuse cookies, or to alert you when cookies are being sent. If they do so, note that some parts of the Site may not function properly.

Consent to Electronic Delivery and Signature. If you use the e-signature feature of this Web site, then you agree to conduct transactions with electronic records and electronic signatures instead of paper-based documents and signatures. You are under no obligation to transact business electronically. You may choose to use paper forms from the school or, if available, forms from the school web-site.

By your use of the e-signature feature of this Web site, you represent and warrant without reservation that you have the legal right, power, and authority to agree to all terms contained in the electronic records on this Web site on behalf of yourself as the parent or legal guardian of a student or students enrolled at the School. You further agree that your use of the e-signature feature of this Web site constitutes an “electronic signature” as defined by the Electronic Signatures in Global and National Commerce Act (“E-Sign”) and the Uniform Electronic Transactions Act (“UETA”) and that you have formed, executed, entered into, accepted the terms of, and otherwise authenticated the terms specified herein for the use of the e-signature feature of this Web site. You further acknowledge and agree that proceeding to use the e-signature feature of this Web site constitutes your full agreement to all terms and conditions contained herein and that such agreement is an “electronic record” for purposes of E-Sign, UETA, and the Uniform Computer Information Transactions Act and as such is completely valid, has legal effect, is enforceable, and is binding on, and non-refutable by you, as if it were any other duly executed paper contract.

By your use of the e-signature feature of this Web site you are deemed to have read every record and document before electronically signing same. If you do not understand any record or document, then you agree to communicate directly with the School concerning your understanding prior to your continued use of the e-signature feature of this Web site. By your use of the e-signature feature of this Web site, you consent to jurisdiction and venue in Virginia, for any dispute arising out of same, and you further agree that ZippSlip shall be entitled to reasonable attorneys fees, including pre-litigation fees, for enforcement in any court of any of the terms and conditions contained herein.

Revocation of electronic delivery. You have the right to withdraw your consent to receive/obtain communication at any time. If you wish to withdraw your consent, contact the School.

Hardware, software and operating system. You are responsible for installation, maintenance, and operation of your computer, browser and software. ZippSlip is not responsible for errors or failures from any malfunction of your computer, browser or software. ZippSlip is also not responsible for computer viruses or related problems associated with use of an online system.

Security. Under this User Agreement it is your responsibility to keep your ZippSlip password and PIN under your personal control at all times. You are responsible for maintaining the confidentiality of your account, password and PIN, and for restricting access to your computer and mobile device. You agree to notify the School promptly of any unauthorized use of your password or breach of security. ZippSlip is not responsible for any loss that you may incur as a result of any unauthorized person using your account or your password.

Disclaimer of Liabilities. ZIPPSLIP IS NOT LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM (1) YOUR FAILURE TO COMPLY WITH THIS AGREEMENT; (2)YOUR FAILURE TO ACCESS, DOWNLOAD, SAVE OR PRINT DOCUMENTS; (3) PROBLEMS OR TECHNICAL FAILURES WITH YOUR EQUIPMENT; (4) ANY ERRORS OR DELAYS IN COMMUNICATION OR TRANSMISSION LINES; AND(5) ANY OCCURRENCE BEYOND ZIPPSLIP’S REASONABLE CONTROL.

Additional User Agreements, Terms and Conditions. Portions of ZippSlip, or school web sites incorporating ZippSlip components, may be governed by additional user agreements or terms and conditions. All such additional user agreements or terms and conditions are hereby incorporated by reference into this User Agreement. In the event of a conflict between such additional user agreements or terms and conditions and this User Agreement, this User Agreement shall control.

Modification of this User Agreement. ZippSlip may wish to update or change the User Agreement from time to time to reflect changes in the service, changes in the laws affecting the Services, or for other good reasons. ZippSlip will make reasonable efforts to notify ZippSlip participants of any changes, however, ZippSlip reserves the right to make these changes unilaterally, and your continued access to or use of ZippSlip shall constitute your consent to such change.

No Unlawful or Prohibited Use. As a condition of your use of ZippSlip, you agree that you will not use ZippSlip for any purpose that is unlawful or contrary to this User Agreement. You also may not use ZippSlip in any manner that could damage, disable, overburden, or impair the ZippSlip system or interfere with any other party’s use and enjoyment of them. You may not attempt to gain unauthorized access to any ZippSlip account, computer systems or networks associated with ZippSlip. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through ZippSlip.

Termination/Access Restriction. ZippSlip and your school reserves the right, in their sole discretion, to terminate your access to ZippSlip or any portion thereof at any time, without notice.

General. ZippSlip’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this User Agreement is in derogation of ZippSlip’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of ZippSlip or information provided to or gathered by ZippSlip with respect to such use. You agree to indemnify and hold ZippSlip harmless from any claim, demand, or damage, including reasonable attorneys’ fees, asserted by any third party due to or arising out of your use of or conduct on ZippSlip. If any part of this User Agreement is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of this User Agreement shall continue in effect. This User Agreement, including the documents expressly incorporated by reference above, constitute the entire agreement between you and ZippSlip with respect to ZippSlip.
